Terms of Service

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf.

Your account

You are responsible for the information you provide when you create your account, for keeping your sign-in credentials secure, and for all activity under your account. If you believe someone has used your account without your permission, please contact us right away.

AI-generated content

JustPhrase uses artificial intelligence to generate sentences, dialogues, monologues, translations, explanations, and audio. AI-generated content can be inaccurate, incomplete, or unsuitable for a particular situation. It is meant to support your own communication, not to replace your judgment, so please review it before relying on it, especially in high-stakes professional, legal, medical, or financial contexts. Nothing in the Service is professional advice.

Subscriptions and payments

Some features of the Service are available only with a paid subscription ("Premium"). The included features, available plans, and prices are shown in the app before you purchase.

Billing

Subscriptions purchased in our mobile apps are sold and billed by Apple through the App Store, or by Google through Google Play. Payment is charged to the account you use with that store when you confirm your purchase, and your purchase is also subject to that store's terms.

Automatic renewal

Subscriptions renew automatically at the end of each billing period (monthly or yearly, depending on your plan) at the then-current price unless you cancel at least 24 hours before the current period ends. Your account will be charged for renewal within the 24 hours before the current period ends.

Free trials

Some plans may include a free trial, as shown in the app at the time of purchase. Unless you cancel at least 24 hours before the trial ends, it converts to a paid subscription and you will be charged for the plan you selected. Any unused portion of a free trial is forfeited when you purchase a subscription.

Managing and canceling

You can manage or cancel your subscription at any time in your App Store or Google Play account settings, or from Settings in the JustPhrase app. When you cancel, you keep Premium access until the end of the current billing period, and you will not be charged again.

Refunds

Because the App Store and Google Play process payments for subscriptions purchased in our apps, Apple or Google handles refund requests for those purchases under its own policies. Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial billing periods.

Price changes

We may change subscription prices. If we do, we will notify you in advance as required by the App Store or Google Play and, where required, the new price will not apply to you unless you agree to it.

Your content

You keep ownership of the content you add to the Service, such as your questions, the context you describe, and the sentences, dialogues, and monologues you save ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content, and to share it with the service providers described in our Privacy Policy, solely to operate and provide the Service to you. This license ends when you delete Your Content or your account, except for copies we must keep for a limited time for legal or backup purposes.

You are responsible for Your Content and must have the right to use it. Please do not submit information you are not permitted to share, such as confidential information belonging to your employer or clients.

Acceptable use

You agree not to:

• use the Service in violation of any law or the rights of others;
• submit content that is unlawful, harassing, hateful, or sexually explicit;
• access the Service by automated means, or call its APIs outside the official apps;
• circumvent usage limits, subscription checks, or other technical restrictions;
• copy, resell, or reverse engineer the Service, except where the law allows; or
• interfere with or disrupt the Service or the systems that run it.

Our intellectual property

The Service, including its software, design, text, graphics, and the JustPhrase name and logo, is owned by us or our licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service. You may use the content the Service generates for you in your own personal and professional communication.

Termination and account deletion

You can stop using the Service at any time, and you can permanently delete your account from Settings in the app or on the web. Deleting your account does not cancel a subscription purchased through the App Store or Google Play; please cancel it in your store account settings to stop future charges.

We may suspend or terminate your access to the Service if you violate these Terms, or if we need to do so to comply with the law or to protect the Service or its users. We may also modify or discontinue features of the Service. Provisions of these Terms that by their nature should survive termination will survive it.

Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that generated content will be accurate or appropriate for your purpose.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim arose or $50. Some jurisdictions do not allow certain of these limitations, so they may not apply to you.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses, including reasonable legal fees, arising out of Your Content or your violation of these Terms or of any law.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Nothing in these Terms limits any rights you have under the consumer protection laws of the country where you live.

Additional terms for the App Store

If you downloaded a JustPhrase app from Apple's App Store, the following also applies:

• These Terms are between you and us only, not Apple, and we, not Apple, are solely responsible for the app and its content.
• Your license to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection or privacy laws.
• We, not Apple, are responsible for investigating, defending, settling, and discharging any third-party claim that the app or your use of it infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly. By continuing to use the Service after the changes take effect, you agree to the updated Terms.
